Default PS4 Games Can’t Be Rented or Resold; Sony May Record You On PlayStation Network

Sony must approve all renting and reselling of used PlayStation 4 games and may record PlayStation Network communications, the updated terms of use for PS4 software says.

Section 7.1, under the subtitle “Resale,” says, ”You must not resell either Disc-based Software or Software Downloads, unless expressly authorized by us and, if the publisher is another company, additionally by the publisher.”

A section of the terms of use that describes software licensing further explains that any PlayStation 4 games you buy are only licensed to you, not owned by you: “All Software is licensed, not sold, which means you acquire rights to use the Software, as described in these Terms, but you do not acquire ownership of the Software. If you do not comply with these Terms, we can terminate your Software License which means you will no longer have the right to use the Software.”

This means, according to the terms of use, that “You must not lease, rent, sublicense, publish, modify, adapt, or translate any portion of the Software.”
The PlayStation 4 software terms of use definitely clarify Sony’s famous “Used Game Instructional Video” from E3. While gamers initially thought the video meant people can do whatever they choose with PS4 software, it appears the “sharing” demonstrated in the video is limited to sharing games with friends, and not selling them to your local game store.

Another section of the software terms of use says Sony will monitor online communications. “Your use of PSN and our community features may be recorded and collected by us or sent to us by other users,” Sony explained in Section 14 of the terms of use. “Any information collected in this way . . . may be used by us or our affiliated companies to enforce these Terms and the SEN Terms of Service, to comply with the law, to protect our rights and those of our licensors and users, and to protect the personal safety of our employees and users.”

However, Sony also stated that they “can’t monitor” all activity on the PlayStation Network, and will “make no commitment to do so.”

This whole text, the entire context... it scares me to no end.

So it's basicly, "Don't like our products and want to sell it away? Big Brother is watching you!" ?

Yeah, PS4 just bought the old Xbox One Kinect problem again. Really surprising that they would do such things.

From the way it looks, it seems that all of the Gen VIII consoles are having trouble. Wii U lacks the big games, Xbox One seems to be the same as Xbox 360, and the PS4 is now facing this, and the price problem down in Brazil.

I think I'll just keep my Xbox 360 until they shut down Xbox Live for that.

now the problems with the ps4 leaks out.

They may have had the upper hand but all these problems make it sound like an xbox one 2.0

Have to agree with Markiee there. I wasn't planning to get any of the next-gen consoles - the only one that would have been an option was the PS4 if and when Gran Turismo 7 came out.

But now... it's like a direct slap in the face to companies like GameStop. Some of us don't have the money to buy new games, and now this...

I always go with Nintendo, while PS4 and Xbox may have more appealing games depending on what genre you're interested in, Nintendo is at least a safe bet, even if you're playing modest games in comparison.
