The 8th Amendment. It prohibits excessive bail, excessive fines, and most importantly, cruel and unusual punishments.

My question to you all is, how far should they take "cruel and unusual punishments?"

Cruel and unusual would make the limit to maiming for me. So far people are so worried about things such as water boarding and simple threats. So in a nutshell:

Maiming is cruel and unusual.

Neutering criminals is considered cruel or unusual, but it sure is practical.

It is not practical at all. You cannot take away someone's desire. That is not what surgical castration does. It prevents you from mating. It does not take away your desire. I've been researching this since we last discussed it.

Too many, capital punishment falls under cruel and unusual punishment. I personally am for the death penalty.

However I do think some of the interrogation methods can be considered cruel and unusual punishment. I think that under that kind of stress of a 30 hour interrogation people would confess to anything.

Just twitch the right button on someone, and you have everything you WANT to hear, whether it's the truth or not seems not be interesting for the one wanting to hear it anyway...
